Please read these Terms of Service ("Terms") carefully before using the r5i.dev website or engaging our custom software development and IT consulting services (web development, mobile apps, SaaS platforms, API integration, and technical consulting). By requesting services or using our site you agree to these Terms.
Scope of Services
We offer custom software development, web and mobile application development, SaaS platform engineering, API design and integration, UI/UX design, DevOps and cloud infrastructure, and IT consulting services. Specific deliverables, milestones, and estimates will be provided in project proposals, statements of work, or invoices. We do not provide legal, medical, or financial advisory services unless explicitly contracted in writing.
Estimates, Quotes, and Acceptance
Estimates or quotes provided are based on the information available at the time. Additional scope discovered during development may change the final cost. Work will proceed only after you authorize the project scope or accept the provided proposal. Rush or expedited delivery may incur additional fees.
Appointments and Cancellations
Consultations may be scheduled online, by phone, or email. Cancellations should be made 24 hours in advance to avoid cancellation fees. We reserve the right to cancel or reschedule due to team availability.
Payment and Taxes
Payment is due at service completion unless otherwise agreed to in writing. Accepted payment methods will be listed on invoices. You are responsible for any applicable sales or use taxes, duties, and fees.
Client Responsibilities
- Backups: Maintain your own backups of source code and data before granting repository or environment access. While we take precautions, we cannot guarantee against data loss during development or deployment.
- Authorization: You confirm you are authorized to permit work on the repositories, environments, and accounts presented for service.
- Accurate Information: Provide full and accurate information about the project requirements and technical constraints.
Service Work and Deliverables
Source code and project deliverables will be handled with reasonable care. We may create development branches or staging environments to perform work; these will be cleaned up after delivery unless you request retention. Intellectual property rights to custom code developed for you will be assigned upon full payment as specified in the project agreement.
Warranties and Support
We offer a limited warranty on delivered software, typically 30 days of bug fixes after project completion unless otherwise stated in the project agreement. Warranties do not cover issues arising from unauthorized modifications, third-party integrations not in scope, or misuse. For third-party services and APIs, their respective terms and warranties apply.
Limitation of Liability
To the fullest extent permitted by law, r5i.dev and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of business, lost profits, or interruption of business. Our maximum aggregate liability for direct damages arising from our services will not exceed the total fees paid by you for the specific service that gave rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless r5i.dev, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your violation of these Terms or your negligence.
Intellectual Property
All content on the website, including text, graphics, logos, and images, is our property or used with permission. You may not reproduce, distribute, or create derivative works without our consent.
Privacy and Data Handling
Our Privacy Policy explains how we collect and handle personal and project data. By using our services you consent to the collection, use, and disclosure described in that policy.
Third-Party Services
Our services leverage third-party infrastructure for delivery and security, including Cloudflare (for website hosting, DNS, and security challenges via Turnstile) and Google Workspace (for scheduling and email). By using our site, you acknowledge that certain interaction data (e.g., successful Turnstile verification) is processed by these providers to enable the requested service.
Dispute Resolution
Any disputes arising out of or related to these Terms will be governed by the laws of the State of Arizona, without regard to conflict of law rules. If a dispute cannot be resolved informally, the parties agree to submit to the exclusive jurisdiction of the state or federal courts located in Maricopa County, Arizona.
Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted here with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
